Arista Insurance - Prize Draw Terms & Conditions
1. This prize draw is a promotion of Arista Insurance Limited. Registered in England & Wales with registration number 5938669, and whose registered office is at Arista Insurance, Library House, New Road, Brentwood, Essex CM14 4GD.
2. Arista reserves the right to cancel or amend the prize draw or these terms & conditions at any time without prior notice. A copy of the terms & conditions may also be obtained by sending a stamped addressed envelope to: Arista Prize Draw, Arista Insurance, 68 Lombard Street, London EC3V 9LJ.
3. In the event of any dispute regarding the rules or prize draw, the decision of Arista shall be final and no correspondence or discussion shall be entered into.
Qualifying Entrants
4. Entrants must be a representative from an FSA registered insurance broker or intermediary based in England, Wales, Scotland or Northern Ireland to apply for an Arista agency and be entered into the prize draw. Agency applications cannot be accepted from insurance brokers or intermediaries located in the Channel Islands or Isle of Man.
5. Only one entry per company is allowed and multiple entries will result in an entrant being disqualified. Where a winner has been selected and Arista discovers or has reasonable grounds to believe the winner has made more than one entry, Arista reserves the right to select an alternative winner. Any further entrant will be selected on the same criteria as the original entrant and will be subject to these terms & conditions.
6. Entrants must complete an agency application by answering all the questions and submitting an agency application. Only bona fide agency applications will be accepted.
7. The agency application can be completed online at www.arista-insurance.com or in writing using an application form provided by Arista Insurance.
8. To qualify to enter the prize draw you must be resident in the United Kingdom and be 18 years or older.
9. Employees of Arista or any company involved in the prize draw or any advertising agency or web company connected with Arista, or any such person’s subsidiary or associated companies, agents or members of their families or households, are not eligible to enter the prize draw. Arista reserves the right to verify the eligibility of all entrants.
10. In the event that any entrant is disqualified from the prize draw, Arista in its sole discretion, may decide whether a replacement should be selected. In this event, any further entrant will be selected on the same criteria as the original entrant and will be subject to these terms & conditions.
Prize Draw Entries
11. Only agency applications received before 30th September 2008 will be entered into the prize draw.
12. By entering the prize draw, you hereby warrant that all information submitted by you is true, current and complete.
13. The draw will take place under independent supervision on 3rd October 2008 and Arista Insurance reserves the right to close entry to the draw at any point prior to the draw date if we consider this appropriate, whether due to high volumes of site users causing technical problems or for any other reason. In those circumstances, we will indicate on the home page of the site that entry to the draw has been closed. Wherever reasonably possible we will give advance notice on the home page of any intention to close entry to the draw.
14. The winner will be drawn at random by an independent adjudicator and will be notified by email (using the applicants email contact details they supplied with the agency application) within 14 days of the draw taking place.
15. Before we award the prize, the winner must provide us with such evidence, if any, as we may reasonably request to show that their agency application was genuine and that they have complied with all other requirements of these terms. We reserve the right in our sole discretion to withhold awarding of the prize until proof of eligibility and identity has been confirmed. If satisfactory proof is not produced on request we reserve the right to disqualify the entrant and select another winner. We shall be entitled to recover any prize awarded if it subsequently transpires that the winner was not entitled to it.
16. There is no purchase requirement to enter the prize draw and there is no charge to apply for an agency application with Arista Insurance.
17. If any entrant is found not to have complied fully with these terms then we reserve the right to disqualify them and we may select another winner at random.
Prize
18. The prize is a Flavia SB100 Filter Coffee Machine and is intended for use in the office of the prize draw winner. This prize is non-transferable and there is no cash alternative. Arista reserves the right to substitute prizes of equal or greater value at any time.
19. Return of any prize notification as undeliverable or failure to reply as specified in the notification within the time stated therein may result in disqualification and selection of an alternate winner.
20. You can obtain the winning company name at any time within three months after the date of the draw by sending a stamped self-addressed envelope to Arista Prize Draw, Arista Insurance Limited, 68 Lombard Street, London EC3V 9LJ.
21. Prizes are awarded at Arista’s discretion and no prizes will be awarded as a result of improper actions by or on behalf of any entrant.
22. In consideration of Arista agreeing to consider entrants to the prize draw, each entrant hereby assigns to Arista the complete copyright and all other rights in any entry, which shall be for the full period of copyright. Arista shall be free to assign such rights to third parties.
Intellectual Property Rights
23. Furthermore, any information submitted by you must be personal to and relate specifically to you. You hereby warrant that the information which you submit and/or distribute will not infringe the intellectual property, privacy or any other rights of any third party, and will not contain anything which is libellous, defamatory, obscene, indecent, harassing or threatening. If relevant, Arista reserves the right, but not the obligation, to screen, filter and/or monitor information provided by you and to edit, refuse to distribute or remove the same.
Liability
24. Neither Arista Insurance nor our suppliers or agents in connection with this promotion will be liable for entries that are late, not received, lost or go astray, or for technical, hardware, or software failures of any kind or lost or unavailable network or other connections which may limit or prevent your ability to participate in the draw, whether or not arising during operation or transmission as a result of server failure, viruses, bugs or other causes outside our control.
25. We cannot promise that the site and other services relating to the promotion will be free from errors or omissions, or that they will be available uninterrupted and in a fully operational condition throughout the promotion period. Services and/or entry into the promotion may be suspended temporarily and without notice in the event of system failure, maintenance or repair or for causes reasonably beyond our control. However nothing in these terms will limit our liability for death or personal injury caused by our negligence or for fraud.
26. Nothing shall exclude Arista’s liability for death or personal injury as a result of its negligence.
Data Protection
27. Any personal data relating to entrants will be used solely in accordance with current UK data protection legislation and will not be disclosed to a third party without the individual’s prior consent.
Jurisdiction
28. By completing an Arista Insurance agency application you will be deemed to have accepted these terms & conditions and to agree to be bound by them. The laws of England and Wales govern these terms and conditions.
